KIRA for Companies – Usage Agreement

Article One – Definition

Kira is a software application owned by ROUTE ENTEGRE ÇÖZÜMLER YAZILIM PROGRAMLAMA LİMİTED ŞİRKETİ.

This is a limited liability company registered in Turkey, Istanbul, under number (7351902214), with its registered address at:

GÖKEVLER MAH. 2312. SK. BURC İSTANBUL 18 BLOK NO: 18 J İÇ KAPI NO: 207 ESENYURT / İSTANBUL.

The Kira app and platform provide services that help car rental companies showcase and market their vehicles, in addition to administrative tools that help companies manage and organize their internal operations.

Article Two – Terms of Use

• Using the app and accepting the terms of use is conclusive evidence of your full and complete understanding, agreement, and commitment to abide by these terms. We may change the terms from time to time, and we advise you to review the site to check for any changes to the terms that apply to car rental companies.
• These terms and conditions, together with the Privacy Policy, constitute our agreement with you for the services we provide in the KIRA app built for companies.
• These terms apply to all car rental company services provided by the app.
• All dealings are subject to the provisions of Turkish law.
• All data and information of companies registered in the app are subject to the Privacy Policy.
• Car rentals are subject to the terms and conditions of the renting company, which can be added through the company's account in the app or on the web.
• The renting company bears full responsibility for verifying the renter's information, and has complete freedom to take the necessary guarantees in accordance with Turkish law and to reject a request if it finds the renter's documents and data to be incomplete.
• KIRA bears no material or moral damage suffered by a car rental company as a result of renting out vehicles. The renting company must finalize the contracts and obtain the necessary guarantees from renters, and in the event of any damage the company is solely responsible for addressing its consequences through its own procedures.
• Neither the KIRA app nor its owning company bears any damage resulting from a legal issue with the legal licenses of the car rental companies participating in the app, and in the event of a legal issue or harm to the end renter, the car rental company is solely responsible for it.
• The KIRA app has the right to use car rental companies' data for promotional and marketing purposes.
• The KIRA app does not collect any funds from the end renter, and the renting company bears full responsibility for collecting its dues from the renter.
• The KIRA app has the right to temporarily or permanently suspend a car rental company's account if it violates the terms of use, receives a high number of negative ratings from renters, or uses the app outside its intended scope.
• The Kira app and platform bear no legal responsibility resulting from companies using textual or visual content — images or videos — owned by other parties or individuals. In the event a report is received of an infringement of another party's material or intellectual property rights, the KIRA app has the right to immediately and without prior notice temporarily close the infringing company's account until the content is removed, and if the company does not respond, the Kira app and platform have the right to permanently close the company's account without any compensation.
• KIRA has the right to collect a fee of 10% from the car rental company for vehicle bookings made through the app, excluding manual bookings made by the company's own accounts. If the company fails to settle its obligations of subscriptions or commissions, the Kira app and platform have the right to suspend the company's account and to claim compensation and damages before the competent legal authorities.
• The users of the Kira app and platform undertake and pledge that the data and content they provide on the Kira platform and app are accurate, secure, and compliant with the law, and the Kira app and platform bear no responsibility for verifying the accuracy of the data provided by users.
• Users may not transfer their rights and obligations under the user agreement, in whole or in part, to any third party without the written consent of Kira or its owning company.
